African Tours and Holidays

These General Terms and Conditions (“Terms”) govern your access to and use of the Africa Tours and Holidays website, booking platform, and related services (collectively, the “Platform”). By accessing, browsing, or making a booking through our Platform, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our Platform or services.

1. About Us

Africa Tours and Holidays (“we,” “us,” or “our”) operates an online travel and booking platform that connects travelers with tour operators, guides, lodges, hotels, transport providers, and other travel service providers (collectively, “Suppliers”) across the African continent.

We act as an intermediary and booking facilitator. We do not own, operate, or directly provide tours, accommodation, transportation, or travel experiences unless explicitly stated.

2. Scope of Services

2.1. The Platform allows users (“Users,” “you”) to explore, compare, and book tours, safaris, holiday packages, accommodation, transportation, and travel-related services in various African countries.

2.2. All travel services displayed on the Platform are provided by independent third-party Suppliers. Each Supplier is solely responsible for the delivery, quality, safety, and legality of their services.

2.3. These Terms apply to all Users of the Platform, including browsers, registered users, and customers who make bookings.

3. Booking and Contractual Relationship

3.1. When you make a booking through the Platform, a direct contract (“Service Agreement”) is formed between you and the Supplier, not with Africa Tours and Holidays.

3.2. We act as a commercial agent for Suppliers, authorized to:

  • Display their services,

  • Facilitate bookings,

  • Collect payments on their behalf.

3.3. Africa Tours and Holidays is not a tour operator, organizer, or provider of travel services and is not a party to the Service Agreement.

4. Prices, Payments, and Fees

4.1. All prices displayed on the Platform are set by the Suppliers and may include service fees, taxes, or commissions unless stated otherwise.

4.2. Prices may vary due to:

  • Seasonality,

  • Availability,

  • Exchange rate fluctuations,

  • Local taxes or government fees.

4.3. Full or partial payment may be required at the time of booking, depending on the Supplier’s policy.

4.4. Payments are processed securely through authorized payment gateways. By making a payment, you confirm that you are authorized to use the selected payment method.

5. Cancellations, Changes, and Refunds

5.1. Cancellation and refund policies vary by Supplier and service. The applicable policy will be clearly displayed during the booking process.

5.2. Any request for cancellation, modification, or rescheduling must be made through the Platform or as instructed in your booking confirmation.

5.3. Refunds, if applicable, will be processed according to the Supplier’s terms and returned to the original payment method, unless otherwise stated.

5.4. No refunds will be issued for:

  • No-shows,

  • Late arrivals,

  • Unused services,

  • unless explicitly permitted by the Supplier.

6. Travel Responsibilities

6.1. You are responsible for ensuring that you:

  • Hold valid passports and visas,

  • Comply with immigration, customs, and health regulations,

  • Obtain required vaccinations and travel insurance.

6.2. Africa Tours and Holidays is not responsible for denied entry, missed tours, or losses arising from failure to meet travel requirements.

6.3. Travel insurance covering medical expenses, trip cancellations, delays, and personal belongings is strongly recommended.

7. Health, Safety, and Risk

7.1. Travel activities in Africa may involve inherent risks, including wildlife encounters, outdoor activities, weather conditions, and local infrastructure.

7.2. By booking a service, you acknowledge and accept these risks.

7.3. Africa Tours and Holidays is not responsible for personal injury, illness, death, property damage, or losses arising from Supplier services.

8. User Accounts and Platform Use

8.1. You may be required to create an account to access certain features.

8.2. You are responsible for maintaining the confidentiality of your login details and all activities conducted through your account.

8.3. You agree not to:

  • Use the Platform for unlawful or commercial resale purposes,

  • Misuse content or data,

  • Attempt unauthorized access or disruption of the Platform.

9. Reviews and User Content

9.1. Users may submit reviews, ratings, photos, or other content (“User Content”).

9.2. By submitting User Content, you grant Africa Tours and Holidays a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content for marketing and operational purposes.

9.3. User Content must not be false, misleading, offensive, defamatory, or violate third-party rights.

10. Intellectual Property

10.1. All Platform content, including text, images, logos, design, and software, is the property of Africa Tours and Holidays or its licensors.

10.2. You may not copy, reproduce, modify, or distribute any content without prior written permission.

11. Limitation of Liability

11.1. To the maximum extent permitted by law, Africa Tours and Holidays shall not be liable for:

  • Acts or omissions of Suppliers,

  • Travel disruptions,

  • Accidents, injuries, illnesses, or losses,

  • Force majeure events (e.g., weather, strikes, government actions).

11.2. Our total liability, if any, shall not exceed the amount paid by you to us for the relevant booking.

12. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, political unrest, or government restrictions.

13. Data Protection and Privacy

We collect and process personal data in accordance with applicable data protection laws. For details, please refer to our Privacy Policy available on the Platform.

14. Termination

14.1. We reserve the right to suspend or terminate access to the Platform if you violate these Terms.

14.2. Termination does not affect existing bookings governed by Supplier terms.

15. Governing Law and Jurisdiction

15.1. These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction where Africa Tours and Holidays is registered, unless otherwise required by consumer protection laws.

15.2. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.

16. Amendments

We may update these Terms from time to time. Updated Terms will be posted on the Platform and become effective upon publication.
